Conditions Générales de Vente (CGV) - E-commerce website in Switzerland

  1. Scope of application

These General Terms and Conditions of Sale (GTCS) govern all commercial transactions concluded between Sellerie moto Dubouloz, whose registered office is located at 20 chemin du Vieux-Puits, 1228 Plan-les-Ouates in Switzerland, registered in the commercial register under number [Numéro]hereinafter referred to as “the Seller”, and users of the www.sdubouloz.ch e-commerce site, hereinafter referred to as “the Customers”. By placing an order on our site, the Customer unreservedly accepts all the terms and conditions set out below.

  1. Products & Prices

2.1. The products offered for sale are accurately described on the site. Product photographs are non-contractual and may differ slightly from the actual product.

2.2. The prices indicated on the site are in Swiss francs (CHF) and include the applicable VAT. Delivery charges are payable by the customer and are indicated during the order process before final validation.

  1. Controls

3.1. Customers can place orders online via our e-commerce site. Before finalizing the order, the Customer will have the opportunity to check the details of the order, its total price and to correct any errors.

3.2. The order will be considered final only after validation of the payment by our services. The Vendor reserves the right to refuse any order in the event of a dispute with the Customer or total or partial non-payment of a previous order.

  1. Payment

4.1. Payment for products is made online when the order is placed, using the payment methods available on the site.

4.2. The Vendor guarantees the security of transactions carried out on the e-commerce site and does not retain the Customer’s bank details after payment.

  1. Delivery

5.1. The Vendor undertakes to deliver the products within the deadlines indicated at the time of the order, except in exceptional circumstances beyond its control (force majeure, strike, etc.).

5.2. Delivery costs are indicated at the time of ordering and may vary depending on the destination and delivery method chosen.

5.3. In the event of late delivery, the Customer will be informed as soon as possible and may cancel the order if the product has not yet been dispatched.

  1. Right of withdrawal

6.1. In accordance with Swiss consumer protection legislation, the customer has 14 days from receipt of the products to exercise his right of withdrawal, without having to justify his decision.

6.2. The Customer must inform the Vendor of his decision to withdraw in writing (by e-mail or post) and return the products in their original condition, at his expense.

6.3. The Vendor will reimburse the Customer within a reasonable time after receipt of the returned products.

  1. Warranty and liability

7.1. The Vendor guarantees that the products sold on its site conform to the description given and are free from any hidden defect.

7.2. The Vendor’s liability is limited to the amount of the order placed by the Customer.

7.3. The Seller cannot be held responsible for any indirect damage caused by the use of the products.

  1. Privacy Policy

8.1. The Seller undertakes to comply with Swiss legislation on the protection of personal data and to treat the Customer’s personal information as confidential.

8.2. Customers may consult our privacy policy to learn more about the use of their data.

  1. Disputes and Applicable Law

9.1. In the event of a dispute between the Vendor and the Customer, the parties will endeavour to find an amicable solution.

9.2. In the absence of amicable agreement, any dispute relating to these GTC shall be submitted to the competent courts in Switzerland.

9.3. These GTC are governed by Swiss law.

  1. Modification of the GTC

10.1. The Seller reserves the right to modify these GTC at any time. The GCS applicable are those in force at the time the order is placed.
